What is Record Retrieval?

Record retrieval is the process of locating relevant documents, files, and records that are often lost or buried away. Locating these documents can be a lengthy and resource-intensive process if handled internally. However, they can make all the difference in a legal outcome.

What Are Some of the Records That Can Be Retrieved?

Medical records can be vital to the outcome of your case. Medical records can be obtained by Bosco Legal Services with either a signed authorization from the patient or a records subpoena. Bosco Legal Services can assist with both California state court subpoenas and Federal District Court subpoenas. We also keep a repository of authorizations for a variety of medical facilities. Reach out to our records department for assistance with either your authorization or subpoena needs.

Not only can Bosco Legal Services obtain court records from Federal District and California state courts, we can also assist with obtaining records from the Workers’ Compensation Appeals Board. As these are public records, a subpoena is not needed. Bosco Legal Services will use a public records request form to obtain the needed files for you.

Financial records, such as those held by banks and investment companies are heavily protected by those financial institutions. The Notice to Consumer and Employee must be completed correctly and properly served in order to obtain the records needed. There are also important timelines to be followed before the subpoena can be served on the witness. Bosco Legal Services has experience obtaining these difficult records and can assist you with the proper Notices and timing.

During the course of an insurance claims investigation, insurance claim files can be subpoenaed in both Federal District and California state cases. To identify and obtain the correct file, we need the name of the insured, the insurance policy number, claim number, and date of loss. Similar to other records, a proper Notice to Consumer or Employee must also be served.

Record retrieval is a complicated process with many regulatory and legal implications. We’re here to bring clarity to the process.

There are two categories of records that need a signed authorization for release in California:

 

  • Sensitive medical records detailing treatment for mental illness-, child-, elder-, sexual-, or domestic abuse, genetic testing, HIV/AIDS testing and/or treatment, psychotherapy notes, drug and alcohol abuse, and/or recovery.
  • Telephone records (including wireless phones) are protected. California Civil Procedure Code § 1985.3(f) states a subpoena duces tecum for personal records maintained by a telephone corporation (which is a public utility, as defined in Section 216 of the Public Utilities Code) shall not be valid or effective unless it includes a consent to release, signed by the consumer whose records are requested, as required by Section 2891 of the Public Utilities Code. In order to obtain phone records for a California account, a signed authorization is needed from the account holder (often not the actual user of the phone).

We do not email medical records. Instead, we use a secure website to manage and deliver digital records. Once a file is ready, you will receive an email with a protected link to download it.
